Terms and Conditions

STATUSFLAMINGO hereby rents the vehicle to the customer signing these Terms and Conditions, by virtue of which the customer acknowledges and agrees to them.

1. Vehicle return

The Customer undertakes to return the vehicle in the same condition as it was received. In case of non-compliance, the following penalties apply:

a) Loss or destruction of the vehicle documentation constitutes an obligation for the customer to compensate the company with €100 for the related losses, in particular expenses resulting from issuing duplicate documentation and administrative costs.

b) A refueling charge will be applied if the vehicle is returned with a lower fuel level than at the time of pickup (refueling cost €15 plus the value of the missing fuel).

c) Cleaning: if the vehicle is returned in an unacceptable condition (beyond normal use), a cleaning fee of up to €60 will be charged, according to the company’s price table.

d) In case of damage to the vehicle, responsibility will be assigned to the client, depending on the insurance conditions initially contracted. (See insurance clause in section 2.)

2. Insurance

a) Third-party liability insurance, in accordance with the laws of the country. The customer is responsible for damages caused to the rental vehicle.

  • Small damages, scratches, and windshield chips are charged according to the STATUSFLAMINGO price list, including immobilization costs and administrative handling fees, available at vehicle pickup.
  • Any other damages not included in the list, or more serious damage (preventing the return of the vehicle and requiring temporary withdrawal for repair), will be assessed by an independent expert and charged according to the expert report or repair workshop estimate.
  • In case of accident, towing to the rental station of origin is included.

This liability can be waived upon payment of an additional fee:

b) (C.D.W) Collision Damage Waiver: the customer agrees to pay an additional daily fee, and the company waives the customer’s liability for collision damage to the vehicle above the deposit amount, except for damages to rims, tires, undercarriage, engine, parking fines, traffic fines, fuel system cleaning, and vandalism, provided the vehicle is used in accordance with this agreement and applicable laws. The customer remains fully liable if the vehicle is used in violation of this contract or any law or regulation.

c) (T.W) Theft and vandalism coverage: the customer agrees to pay an additional daily fee according to the policy issued by STATUSFLAMINGO.

d) (P.A.I) Personal Accident Insurance: the customer agrees to pay an additional daily fee according to the policy issued by STATUSFLAMINGO.

e) (S.C.D.W) Super Collision Damage Waiver: provides full coverage for vehicle damage, except for rims, tires, undercarriage, engine, parking fines, traffic fines, and fuel system cleaning.

3. Driver requirements

The minimum driver age is 23 years and the maximum is 65 years, with at least 3 years of driving experience and a valid driving license in Portugal.

4. Vehicle use restrictions

The vehicle shall only be driven by the customer and authorized drivers and shall not be used in the following circumstances:

a) Transport of goods in violation of customs regulations or in any illegal manner;
b) Transport of goods or passengers for any form of compensation;
c) To push or tow any vehicle or trailer;
d) For sporting events;
e) By any person under the influence of alcohol or narcotics.

5. Vehicle delivery

The vehicle is delivered with a warning triangle, standard tools, a spare wheel, marked tires, registration documents, insurance green card, a copy of the rental agreement signed by both parties, and, if applicable, the inspection certificate.

6. Fines

The customer is responsible for all fines. An administrative fee of up to €100 per case will be charged for processing fines. These fees are in addition to the fines imposed by authorities.

7. Accident assistance

In case of accident, towing to the original rental station is available 24 hours a day.

8. Incorrect fuel

In case of incorrect fuel use, the customer is responsible for all costs related to fuel replacement, tank cleaning, engine repair, towing, and any additional damages.

9. Personal belongings

The customer releases STATUSFLAMINGO and its employees from any liability for loss or damage to personal belongings left or transported in the vehicle.

10. Mechanical breakdown

The company is responsible for normal mechanical maintenance. In case the vehicle is immobilized due to mechanical failure not caused by misuse, a vehicle of the same class or higher will be provided at no extra cost.

No replacement vehicle will be provided in case of an accident caused by the renter or mechanical failure due to negligence, nor will any rental fees be refunded.

11. Rental period

The rental ends on the date agreed with the customer. If the rental period is to be extended, the customer must contact the nearest rental station at least 24 hours before the end of the contract. Otherwise, the vehicle will be considered in unauthorized use, subject to legal consequences. The vehicle must be returned to the agreed rental station during business hours unless otherwise authorized.

12. Late return

If the vehicle is not returned at the agreed location, date, and time, all related costs will be the responsibility of the customer.

13. Payment and deposit

Rental costs and additional services must be paid at the beginning of the rental period, according to the current price list. A refundable deposit may be required, corresponding to the insurance excess. The deposit amount depends on the vehicle group.

14. Vehicle unavailability

In case the reserved vehicle is unavailable, the company will provide an equivalent or superior vehicle at no additional cost. Otherwise, the company will refund the amount paid within 30 days of booking.

15. Accident procedure

In case of an accident, the customer must:

a) Obtain names and addresses of all involved parties and witnesses;
b) Not admit responsibility or guilt;
c) Not leave the vehicle unattended without taking appropriate measures;
d) Immediately notify the police;
e) Not move the vehicle until the accident has been properly recorded (photographs from multiple angles must be taken).

16. Accident reporting

In case of accident, loss, damage, or theft, the incident must be reported immediately to the relevant authorities and to STATUSFLAMINGO within 24 hours. The customer must complete the accident report with as much detail as possible; otherwise, insurance coverage (SCDW and PAI) may be considered null and void.

17. Amendments

Any amendments to these Terms and Conditions shall be void unless agreed in writing.

18. Liability disclaimer

The customer releases STATUSFLAMINGO, its agents, and employees from any liability for loss or damage to personal belongings left or transported in the vehicle, at any time before, during, or after the rental period.

19. Delays

STATUSFLAMINGO is not responsible for delays or missed flights caused by breakdowns or accidents.
